Eligibility

• Notify Unphish immediately if you suspect unauthorized access to your account.

Subscriptions, Billing & Refunds

• Some Services require a paid subscription. Fees, billing cycles, and payment terms are set out at the time of purchase or in your subscription agreement.
• Subscriptions automatically renew unless canceled according to the cancellation terms in your plan. You are responsible for all charges incurred prior to cancellation.
• Refunds, if any, are handled pursuant to the refund policy described in your order or subscription agreement.

Acceptable Use

• You agree to use the Services only for lawful and permitted purposes.
• Prohibited activities include (but are not limited to): attempting to access others’ accounts without authorization, engaging in unlawful conduct, submitting false or misleading information, or interfering with the operation of the Services.
• Unphish may suspend or terminate accounts that engage in prohibited activities or that otherwise violate these Terms.

Intellectual Property

• All content, trademarks, logos, software, and materials provided by Unphish are owned by Unphish or its licensors and are protected by applicable intellectual property laws.
• Except as expressly authorized by Unphish, you may not copy, reproduce, modify, distribute, sell, or create derivative works from the Services or content.

Service Availability & Support

• Unphish aims to provide reliable service but does not guarantee uninterrupted availability or zero defects.
• Planned maintenance or emergency work may cause temporary interruptions. We will try to provide notice where practical.
• Support options and service-level details (if any) are described in your service agreement or subscription documentation.

Confidentiality & Data

• “Confidential Information” means non-public information disclosed by either party that is designated as confidential or would reasonably be understood to be confidential.
• Each party agrees to keep the other’s Confidential Information secure and to use it only to perform obligations under these Terms.
• Data processed in connection with the Services will be handled in accordance with our Privacy Policy, which forms part of these Terms.

Data Protection & Privacy

Unphish collects and processes personal data in order to provide the Services. Our Privacy Policy explains what data we collect, how we use it, how long we retain it, and your rights. By using the Services, you consent to such processing and warrant that any personal data you provide has been collected and shared in compliance with applicable law.

Limitations of Liability

• The Services are provided “as-is” and “as available”. Unphish expressly disclaims all warranties to the fullest extent permitted by law, whether express or implied.
• To the maximum extent permitted by applicable law, Unphish will not be liable for any indirect, incidental, special, consequential or exemplary damages, lost profits, loss of data, or business interruption arising out of or in connection with the Services.
• Unphish’s aggregate liability for direct damages arising out of or related to these Terms will not exceed the amount you paid to Unphish for the Services in the 12 months prior to the claim (or $100 if you have not paid any fees).

Indemnification

• You agree to indemnify, defend and hold harmless Unphish and its officers, directors, employees and agents from and against any claims, liabilities, damages, losses and expenses (including reasonable legal fees) arising from your use of the Services or your breach of these Terms.

Termination

• Either party may terminate services in accordance with the applicable subscription or service agreement.
• Unphish may suspend or terminate access immediately if you materially breach these Terms or if required to comply with law or a court order.
• Upon termination, your right to access the Services will end. Any data retention or deletion obligations will be handled according to the Privacy Policy and your agreement.

Governing Law & Dispute Resolution
